1. Acceptance of Terms

By accessing or using the Application, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any of these terms, you must not use the Application.

2. License Grant

Fit Cut Pro ("Company") grants you a personal, non-exclusive, non-transferable, revocable license to use the Application solely for your personal, non-commercial purposes, strictly in accordance with the terms of this Agreement.

3. User Responsibilities

• Assumption of Risk: You acknowledge and agree that your use of the Application is at your sole risk. You are solely responsible for any physical activities, exercises, or routines performed using the Application.
• Health and Safety: Before starting any fitness program or exercise regimen through the Application, consult with a qualified healthcare provider to ensure it is appropriate for your individual health conditions.
• Compliance with Laws: You agree to comply with all applicable laws and regulations while using the Application.

4. Restrictions

You agree not to:

• Modify, reverse engineer, or create derivative works of the Application.
• Use the Application for any unlawful or prohibited activities.
• Transfer, sublicense, or assign your rights under this Agreement to any third party.

5. Disclaimer of Warranties

The Application is provided on an "AS IS" and "AS AVAILABLE" basis. The Company expressly disclaims all warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, non-infringement, and accuracy.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to injuries, health complications, loss of profits, goodwill, use, data, or other intangible losses resulting from:

• Your use or inability to use the Application.
• Any modifications made to the Application.
• Unauthorized access to or alteration of your transmissions or data.
• Any other matter relating to the Application.

7. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with:

• Your access to or use of the Application.
• Your violation of this Agreement.
• Any injury, loss, or damage arising from your use of the Application.

8. Termination

The Company reserves the right to terminate or suspend your access to the Application at any time, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of this Agreement.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law provisions.

10. Severability

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

11. Entire Agreement

This Agreement constitutes the entire agreement between you and the Company regarding the use of the Application and supersedes all prior agreements.

12. Changes to This Agreement

The Company reserves the right to modify or replace this Agreement at any time. It is your responsibility to review this Agreement periodically for changes. Your continued use of the Application following the posting of any changes constitutes acceptance of those changes.
